وَذَهَبَ الْحَنَفِيَّةُ وَأَحْمَدُ فِي رِوَايَةٍ إِلَى التَّفْرِيقِ بَيْنَ الْفَرْضِ وَالْوَاجِبِ ، فَمَدَارُ الْفَرْضِ عِنْدَهُمْ لُغَةً عَلَى الْقَطْعِ ، وَشَرْعًا عَلَى مَا ثَبَتَ بِدَلِيلٍ مُوجِبٍ لِلْعِلْمِ قَطْعًا مِنَ الْكِتَابِ أَوِ السُّنَّةِ الْمُتَوَاتِرَةِ أَوِ الإِجْمَاعِ ، وَمَدَارُ الْوَاجِبِ عِنْدَهُمْ لُغَةً عَلَى السُّقُوطِ وَاللُّزُومِ ، وَشَرْعًا عَلَى مَا يَكُونُ دَلِيلُهُ مُوجِبًا لِلْعِلْمِ ، فَيَثْبُتُ الْوَاجِبُ عِنْدَهُمْ بِدَلِيلٍ ظَنِّيٍّ . 
وَيَظْهَرُ أَثَرُ التَّفْرِيقِ بَيْنَ الْفَرْضِ وَالْوَاجِبِ عِنْدَ الْحَنَفِيَّةِ فِي أَنَّ جَاحِدَ الْفَرْضِ كَافِرٌ ؛ لأَنَّهُ أَنْكَرَ مَا وَجَبَ عَلَيْهِ اعْتِقَادُ فَرْضِيَّتِهِ قَطْعًا ، وَلا يَكْفُرُ جَاحِدُ الْوَاجِبِ ، لأَنَّ دَلِيلَهُ لا يُوجِبُ الاعْتِقَادَ ، وَإِنَّمَا يُوجِبُ الْعَمَلَ ، وَلِذَا يُفَسَّقُ تَارِكُهُ ، وَمِثَالُ الأَوَّلِ الصَّلَوَاتُ الْخَمْسُ ، فَإِنَّهَا فَرْضٌ عِلْمِيٌّ وَعَمَلِيٌّ ، وَمِثَالُ الثَّانِي صَلاةُ الْوِتْرِ عِنْدَ أَبِي حَنِيفَةَ فَهِيَ فَرْضٌ عَمَلِيٌّ ، وَيُقَالُ لَهُ : فَرْضٌ عَمَلا ، وَاجِبٌ اعْتِقَادًا
